Article 3 – Applicability
- These general terms and conditions apply to every offer from Beccom and to every agreement concluded with a consumer via the webshop or other sales channels.
- By placing an order, the consumer declares that they have taken note of these general terms and conditions and agrees to them.
- Deviations from these terms are only valid if confirmed in writing by Beccom in advance.
- If one or more provisions are found to be wholly or partially invalid, the remaining provisions shall remain in full force. The invalid provision shall be replaced by a provision that approximates the original intent as closely as possible.
- Any terms and conditions of the consumer are not applicable, unless explicitly accepted by Beccom in writing.
Article 4 – The offer
- All offers on the webshop are without obligation.
- Obvious errors, mistakes, programming errors, price errors, stock errors, or typographical errors are not binding on Beccom.
- Product photos are for illustrative purposes only. Minor deviations in color, texture, finish, or sizing may occur due to screen settings, production differences, or natural material properties.
- Beccom endeavors to present all product information as accurately and completely as possible. Obvious errors do not entitle the consumer to compensation or dissolution of the agreement.
- If a product turns out to be temporarily unavailable after an order has been placed, Beccom will inform the consumer as soon as possible. In such a case, the consumer is entitled to a refund of the amount already paid or may choose an alternative product.
- Campaigns, discount codes, and promotions are valid only during the specified campaign period and while supplies last.
- Unless explicitly stated otherwise, discount codes cannot be combined.
Article 5 – Conclusion of the agreement
- The agreement is concluded as soon as Beccom has electronically confirmed the order.
- Beccom reserves the right to refuse an order in whole or in part if:
- there is an obvious price or system error;
- the product is no longer available;
- fraud or abuse is suspected;
- payment has not been successfully completed;
- the consumer has previously failed to meet payment obligations.
- If an order cannot be executed, the consumer will be informed as soon as possible. Any payments will be refunded within at most fourteen days using the same payment method used for the original transaction, unless otherwise agreed.
- Beccom may use third parties for the execution of the agreement, including logistics service providers, payment providers, and fulfillment partners.
Article 6 – Prices
- All stated prices include Dutch VAT, unless explicitly stated otherwise.
- Any shipping costs are clearly indicated before finalizing the order.
- Beccom reserves the right to change prices at any time. Price changes do not affect already confirmed orders.
- If an obvious price error has occurred due to a technical failure or human error, Beccom is not obligated to supply the product at that erroneous price.
- Any import duties, customs charges, or local taxes outside the European Union are at the expense of the consumer. If Beccom delivers outside the EU in the future, these costs will be clearly communicated in advance.
Article 7 – Payment
- Payment must be made via one of the payment methods offered during checkout on the webshop.
- Beccom reserves the right to add, change, or remove payment methods.
- The agreement is concluded after the payment has been successfully processed or, if applicable, after the chosen payment service provider has approved the payment.
- If the consumer uses an external payment service provider, such as Klarna or PayPal, the terms and conditions of that payment service provider also apply to the processing of the payment.
- Beccom is not responsible for decisions made by external payment service providers regarding credit checks, payment approvals, or declined transactions.
- If fraud, abuse, or unauthorized use is suspected, Beccom is entitled to refuse an order, demand additional verification, or dissolve the agreement.
Article 8 – Delivery
- Beccom delivers only within the countries available during checkout.
- Orders are processed within the processing times stated on the webshop.
- Stated delivery times are indicative. Exceeding a delivery time does not entitle the consumer to compensation or dissolution of the agreement, unless statutory rules determine otherwise.
- If an order is delayed due to circumstances beyond Beccom's control, the consumer will be informed as soon as possible.
- If delivery proves permanently impossible, the consumer will receive a refund of the purchase amount already paid within at most fourteen days.
- Beccom may deliver an order in multiple partial shipments if this speeds up the delivery or is necessary for product availability. No additional shipping costs will be charged for this.
- The risk of damage to or loss of products passes to the consumer at the moment the order is actually delivered to the specified delivery address or to a recipient designated by the consumer.
Article 9 – Retention of title
- All delivered products remain the property of Beccom until the consumer has fully met all payment obligations.
- As long as title has not passed, the consumer may not pledge, sell, or otherwise transfer the products to third parties.
Article 10 – Right of withdrawal
- The consumer has the right to withdraw from the agreement without providing any reason within a period of fourteen (14) days.
- The withdrawal period begins on the day after the consumer, or a third party designated by the consumer who is not the carrier, has received the product.
- To exercise the right of withdrawal, the consumer must send an unambiguous statement to Beccom within the withdrawal period via the designated return process or by email.
- After withdrawal, the product must be returned within at most fourteen (14) days.
- The consumer must handle the product with care and may only use it to the extent necessary to establish the nature, characteristics, and functioning of the product, as would be possible in a physical store.
Article 11 – Returns
- The consumer may use the legal right of withdrawal as described in Article 10.
- Returns must be shipped within fourteen (14) days after withdrawal according to the return instructions on wearpolarex.com.
- Returned products must:
- be clean;
- have been tried on only and not worn;
- be provided with the original labels;
- be returned in full;
- if reasonably possible, be sent in the original packaging.
- If a product has been used beyond what is necessary to establish its nature, characteristics, and functioning, Beccom may charge for depreciation, to the extent permitted by law.
- The direct costs of a return shipment are at the expense of the consumer, unless Beccom explicitly states otherwise.
- Returns must be sent to the return address designated by Beccom as stated in the return instructions on wearpolarex.com. Beccom reserves the right to change this return address if logistical processing requires it.
- Beccom advises the consumer to send a return shipment with a Track & Trace code or other proof of shipment. The risk of the return shipment remains with the consumer until the product is received by Beccom.
Article 12 – Refunds
- If a return meets the conditions of these general terms and conditions and the legal right of withdrawal, Beccom will refund the payment received.
- Refunds will be made via the same payment method used for the original payment, unless explicitly agreed otherwise.
-
Beccom will perform the refund within at most fourteen (14) days after:
- the return shipment has been received; or
- the consumer has demonstrated that the product has been returned,
whichever is earlier, in accordance with applicable legislation.
- Any additional costs incurred because the consumer chose a more expensive shipping method than the standard offered delivery will not be refunded.
Article 13 – Exceptions to the right of withdrawal
The right of withdrawal does not apply to products:
- that are manufactured according to the consumer's specifications;
- that are clearly personal in nature;
- that are not suitable for return for reasons of health protection or hygiene, and whose seal or protective packaging has been broken after delivery, to the extent permitted by law;
- for which the law provides an exception to the right of withdrawal.
Article 14 – Legal warranty and conformity
- Beccom guarantees that the delivered products comply with the agreement, the reasonable expectations the consumer may have, and applicable statutory provisions.
- If a product does not comply with the agreement, the consumer is entitled to an appropriate solution in accordance with Dutch consumer law.
- The legal warranty does not affect any manufacturer's warranties provided by the manufacturer.
- Normal wear and tear, damage due to improper use, careless maintenance, accidents, modifications to the product, or use contrary to washing or maintenance instructions are not covered by the legal warranty.
- Any complaints regarding a defect must be reported to Beccom via customer service within a reasonable time after the defect has been discovered.
Article 15 – Complaints
- Beccom strives for high customer satisfaction. Complaints can be submitted via info@wearpolarex.com.
- The consumer must describe a complaint as completely as possible and, if relevant, include photos or other supporting evidence.
- Beccom will confirm receipt of the complaint as soon as possible and strives to provide a substantive response within fourteen (14) days.
- If a complaint requires more time, the consumer will receive a message within this period indicating the further processing.
- The filing of a complaint does not suspend the consumer's payment obligations, unless the law dictates otherwise.
Article 16 – Liability
- The liability of Beccom is limited to what results from mandatory applicable law.
- Beccom is not liable for indirect damages, including consequential damages, lost profits, missed savings, or other forms of indirect financial loss, unless there is intent or willful recklessness on the part of Beccom.
- Beccom is not liable for damages resulting from:
- incorrect or improper use of a product;
- failure to follow maintenance or washing instructions;
- normal wear and tear;
- modifications made to the product by the consumer or third parties.
- Nothing in these general terms and conditions excludes or limits liability to the extent that such limitation is not permitted by law.
Article 17 – Force majeure
- Beccom is not required to fulfill its obligations if it is prevented from doing so by force majeure.
- Force majeure includes, but is not limited to:
- natural disasters;
- fire;
- floods;
- pandemics;
- war or terrorist threats;
- strikes;
- government measures;
- cyberattacks;
- failures in payment processors;
- failures in Shopify or other technical systems;
- transport problems;
- shortcomings of suppliers or carriers over which Beccom has no reasonable influence.
- During a situation of force majeure, Beccom's obligations may be suspended.
- If the force majeure lasts longer than thirty (30) days, both parties have the right to terminate the agreement to the extent that it has not yet been executed.
Article 18 – Intellectual property
- All intellectual property rights regarding the webshop, the Polarex brand name, logos, product names, designs, images, texts, videos, graphic design, and other content rest exclusively with Beccom or its licensors.
- Without prior written permission from Beccom, it is not permitted to copy, publish, distribute, or commercially use these materials in whole or in part.
- Placing an order grants the consumer only the right to use the purchased product normally. No intellectual property rights are transferred.
Article 19 – Personal data
- Beccom processes personal data in accordance with applicable privacy legislation.
- The manner in which personal data is collected, processed, secured, and stored is described in the separate Privacy Policy on wearpolarex.com.
Article 20 – Amendment of the general terms and conditions
- Beccom reserves the right to amend these general terms and conditions from time to time.
- For agreements already concluded, the general terms and conditions that were in effect at the time of placing the order remain applicable, unless mandatory law dictates otherwise.
- The most current version of the general terms and conditions is always available via wearpolarex.com.
Article 21 – Applicable law and competent court
- All agreements between Beccom and the consumer are exclusively governed by Dutch law.
- The applicability of the Vienna Sales Convention (CISG) is excluded.
- Disputes shall be submitted to the competent court in the Netherlands, unless mandatory consumer law stipulates that the consumer may bring the case before another competent court.
